Cactus Protector Benelux recognises the importance of data protection and the privacy of its customers and visitors on the website and will treat the personal data of the data subject with due care and only for the specified purposes. We strive optimally to be in line with the recent amendments and the European Regulation 2016/679 of 25 May 2018, as well as the Belgian law of 30 July 2018. This both towards the processing and protection of personal data.

Personal data

You share data with us in various ways. We use data we have received from you as well as data we have collected ourselves. For example, data about your visit to our website. You are not obliged to disclose your personal data, but understand that the provision of certain services becomes impossible if you refuse the processing. You are solely responsible for the accuracy of the data you provide us with.

This is data you share with us without registration: browsing behaviour, origin, search terms. We use this data to maintain and improve our website. This means that we include personal data in anonymous statistics, from which the identity of specific individuals or companies cannot be traced, with the legal basis being the legitimate interests of Cactus Protector Benelux to continuously improve the website and services.

Personal data you communicate to us

  • If you contact us via the website, you will provide us with your email address and contact details.
  • If you want to request a quote via our website, we will receive your name, first name, email address, phone number.
  • As a client, customer, prospect, supplier or other business relation, we obtain your name, e-mail address, telephone number, bank account number, address, possibly your company number and contact details.
  • Cactus Protector Benelux does not process sensitive personal data.

Online data submission

To perform our services we need your name, e-mail address, address(es), payment details and your phone number, for business customers we also ask for the company number. We need these for the execution and invoicing of services requested by you. The legal basis for processing this data is the agreement concluded for the provision of our services. We use the data to deliver the service, to keep you informed about the requested service or to contact you with questions or comments about the agreed service. The legal basis for this is the execution of an agreement made. 

Customer testimonials

When you enter into an agreement with us, we will include the services provided in our portfolio, which we may display on our website and social media (Facebook, X and LinkedIn). The legal basis for this is the pre-established agreement you entered into with us. We ensure that the photos we use are completely anonymous.

Subscribe to the newsletter

You can subscribe to our newsletters. When subscribing, we ask for your name and e-mail address. This will keep you informed of actions, promotions and the latest trends and allow us to invite you to events. The legal basis for this is always your explicit, prior consent. You can withdraw your permission at any time by clicking on "unsubscribe" at the bottom of our newsletters.

If you enter into an agreement with us, we will keep you informed about our updated services and promotions through our newsletter. The legal basis for this is the pre-formulated agreement you entered into with us.

Who has access to your data?

In order to process your personal data, we grant access to your personal data to our employees and appointees. Within Cactus Protector Benelux data are only accessible by responsible persons who must have access to them in function of their duties. We guarantee a similar level of protection by making contractual obligations opposable to these employees and appointees, which are similar to this Privacy Policy.

We do not grant strangers access to your data and take appropriate technical and organisational measures to prevent this. Should unauthorised access to your data still occur, we aim to share this with you in full transparency.

We may also in rare cases transfer your data if we are required to do so by certain laws, regulations and/or case law. It may happen that Cactus Protector Benelux must disclose personal data pursuant to a court order or to comply with other mandatory laws or regulations. In that case, we will make reasonable efforts to inform you in advance, unless this is subject to legal restrictions.

Cactus Protector Benelux fully undertakes that we will not sell, distribute or transfer your personal data to other parties for commercial purposes without your explicit prior consent. We also require this from our external processors. Your personal data is extremely important to us and we expect the same from our external parties!

Retention period of your data

When you place an order, you will receive an invoice, which we will keep according to the legal retention period of 10 years.

If you make an enquiry/contact request, we will keep your data until you proceed with the order, if you do not wish to place an order we will keep your data for 2 years.

Accessing, updating or deleting your data

If you are a prospect or customer of Cactus Protector Benelux, we retain certain data. Therefore, you also have a number of rights regarding this data.

  1. Right of access and inspection

You have the right to access your personal data at any time, free of charge, as well as the use we make of your personal data.

  1. Right of rectification, deletion and restriction

You are free to communicate or not your personal data to Cactus Protector Benelux  In addition, you always have the right to ask us to correct, supplement or delete your personal data. You acknowledge that in case of refusal of communication or request for deletion of personal data, certain services are not available and that deletion or amendment of personal data is not legally possible in a number of cases.

This request clearly states what you wish to know, correct or delete. This request must be signed and dated and include a copy of the front of your identity card. If these conditions are met, we will Cactus Protector Benelux meet your request as soon as possible and notify you accordingly.

If you exercise your right of inspection will Cactus Protector Benelux provide you with an overview of your data that is as complete as possible. Some personal data from classic backup files, log files, history files or archive files may not be included in this overview. These data are not part of the currently processed personal data and are therefore not immediately available and cannot be included. However, they are deleted from these files according to standard processes.

The processing of your personal data does not include profiling, nor will it be subject to automated decisions by us.
